TERMS AND CONDITIONS
SHORT TERM HOLIDAY RENTAL Updated March 2024

Short Term Holiday Rentals at the Deck House, located at Geographe Bay Road, West Busselton, WA, 6280, are subject to the following terms and conditions:

  1. A contract between the Guest(s) and the owner will come into existence when payment is received, and a booking confirmation is issued showing the confirmed holiday dates. The contract binds the main booking Guest & all the members of the said guest’s party. It is the main booking guest’s responsibility to ensure that all members of the party accept the terms of the contract set out in these terms & conditions of booking. Failure to disclose all relevant information or comply with these terms may lead to termination of the contract & loss of the booking.
  2. A refundable damage security deposit is payable before your arrival - $500.00 – this is included within your invoice or is held/verified by the original booking agent ie. Airbnb, VRBO, Booking.com. In making a booking you accept responsibility for any theft, breakage or damage caused by you, pets or any member of your party and agree to indemnify us in full for any loss that we may incur as a result. The security deposit will be returned within days of the end of the booking, less the cost of any damage/breakages.
  3. The balance of payments must be paid no later than two weeks before the commencement of your holiday. If the balance is not received by the due date, your booking will be treated as a cancellation and booking availability opened immediately, forfeiting any fees already paid.
  4. All cancellations must be notified in writing.
  5. We strongly advise that you take out comprehensive travel insurance to cover cancellations. If you choose not to, then you accept responsibility for any loss that you may incur due to your cancellation.
  6. Your booking will not be cancelled by the owner except in exceptional circumstances beyond our control. Notification will be given of the cancellation as soon as possible and we will promptly refund all payments made for your holiday. Our liability for cancellation will be limited to payments made to us. **Reference to Covid-19 conditional lockdowns.
  7. No parties or events – the maximum number of persons using the accommodation – including the main house and extra unit - at any time must not exceed 8 persons and only those listed on the booking form can occupy the property. We reserve the right to terminate the booking without notice and without a refund in the case of a breach of this condition. This occupancy number is a City of Busselton Regulation for this property and is not negotiable.
  8. Bookings will not be accepted from persons under twenty-one (21) years of age, Leavers Groups will not be accommodated, even if accompanied by an over 21 person.
  9. The owner reserves the right to refuse a booking without giving any reason.
  10. We or our representatives reserve the right to enter the property at any time to undertake essential maintenance or for inspection purposes.
  11. Tenancies normally commence at 3.00 pm unless otherwise agreed and guests are required to vacate the rental by 10.00 am on the day of departure. Late departures may incur a penalty deducted from the bond as cleaning access time is reduced requiring extra staff to be called in to complete the changeover. This punctuality allows the accommodation to be thoroughly cleaned and prepared for incoming guests.
  12. Vaping or smoking anywhere inside the premises will result in immediate termination of occupancy and forfeiture of all payments. This must be strictly adhered to, and any damage or extra cleaning caused by smoking or pets will be at your expense.
  13. Pet Rules -A maximum of only 2 small to medium-sized pets are allowed at one time – as agreed upon at the time of booking and considered on its merit. The owners reserve absolute discretion regarding accepting pets with any booking.
  14. Guests are responsible for cleaning up after their pets inside and outside around the house and gardens.
  15. Pets should never be left unattended at the property.
  16. Please use your own bedding for your pets, it is not appropriate to utilise provided guest towels or linen for pets or allow them on the furniture of beds.
  17. There is a ‘Pooch Pack’ in the hall cupboard and older rugs that may be used – please wash and leave before your departure if utilised
  18. There is a pet charge of $50.00 per pet per stay. This will be shown on your invoice. Any excessive cleaning requirements due to pet activity will be deducted from the bond or claimed through the original booking portal.
  19. Damages and breakages – please treat the facilities & accommodation with due care so that other guests may continue to enjoy them. If you notice something is missing or damaged in your accommodation, please let us know immediately so that we can take appropriate action. If there has been any damage or breakages during your stay, we would be grateful if you could report them promptly, especially before check-out. The accommodation will be inspected at the end of the holiday & you may be charged for any loss or damage. Small incidental damage may be considered wear and tear – however your reporting of such incidents is appreciated, so future guests may enjoy the property as you have.
  20. Please do not move any furniture from one room to another or drag furniture across floors.
  21. Please remove muddy or sandy shoes before entering the house. If coming from the beach, please de-sand yourself and your pets and rinse your feet before entering the house. It is not appropriate to use the pool for this purpose. Wet pets inside the house are not tolerated.
  22. Please lock the doors and close the windows when you leave the property unoccupied.
  23. Please make sure you switch off lights, heating, air conditioning or any electrical appliances when you go out – we’re an eco-friendly holiday home.
  24. Please don’t take any bath towels with you to the beach. There are some spare towels in the hall cupboard, however we encourage guests to bring their own beach towels and accessories.
  25. The owner reserves the right to make a charge to cover additional cleaning costs if the client leaves the property in an unacceptable condition, or it is evident the property has been used for purposes outside these terms and conditions. This additional charge will be taken from the Bond or claimed through your booking portal and advised in writing.
  26. Please note that if any keys issued are not returned at the end of your stay, then the cost of replacement or return will be charged to you.
  27. The Guest may in no circumstance re-let or sublet the property, even free of charge. This will result in the immediate cancellation of your booking and the requirement to vacate the property.
  28. The owner shall not be liable for any temporary defect or malfunction of any equipment, machinery or appliance in the building, grounds, or pool.
  29. No compensation will be given for any temporary outage of electricity, gas, water, internet connection, television service, or pool operational equipment.
  30. The owners are not responsible for the loss or damage of any personal belongings or valuables of guests
  31. All inventory must remain in the property and not be taken to another property.
  32. Swimming pool - Please avoid using glass or sharp objects in or near the pool. Guests should shower before entering the water to rinse off creams and sand.
  33. Please use the cover to assist in pool heating. (It is recommended to roll up cover in strong winds to avoid damage).
  34. When rolling cover please take the time to roll flat onto the rollers to avoid creasing damage. The ‘cover’ for the cover may also be attached for extra protection from sun and wind.
  35. Regular professional service checks are carried out by Busselton Pools and Spa, Busselton to ensure water quality and operational efficiency.
  36. Pool water quality and filtration are checked and balanced at the beginning of every stay – the owners do not accept responsibility for incidental breakdowns of pool equipment resulting in less-than-desirable water quality. --Any situation where the pool is unacceptable to swim in due to a breakdown or other incident, will be communicated to the current guest as soon as detected. The owners will endeavour to rectify any such situation as soon as feasibly possible.
  37. Guests will be notified directly of any malfunction or water quality loss as soon as detected. Please contact owners should you have any concerns, and the situation will be investigated and addressed immediately. Refer #29.
  38. Guests are responsible for the safety and security of their children at all times. Never leave children without adult supervision at the property or in and around the pool. The owners do not accept responsibility for any accident or incident causing harm to guests, their children, or pets.
  39. Please park vehicles in the designated parking spaces, ensuring cars do not block access to other properties. Parking is limited to 2 vehicles in the driveway end to end. Another behind the remote sliding gate, and 2 on the verge immediately in front of the house. Do not park on neighbours’ verges.
  40. There is more street parking around the corner on Craig Street for visitors.
  41. Please respect the neighbouring community and try to keep noise levels to a minimum, especially between 10.00 pm and 8.00 am.
  42. We reserve the right to terminate a holiday without compensation where the unreasonable behaviour of the persons named on the booking (or their guests) may impair the enjoyment, comfort, or health of others.
  43. Barbecue – please use the designated barbecue utensils and clean the barbecue after use. Please also regularly empty the drip tray, failure to maintain appropriately may result in a deduction from your Bond or a claim from your booking agent. ($50.00)
  44. Candles are not allowed inside the house.
  45. Check-out at 10.00 am on the date of departure. It would be appreciated if guests would empty inside bins, clean dirty dishes, and put away, and leave the property reasonably close to how it was received.
  46. Any problem or complaint that a guest may have concerning their holiday must be immediately reported directly to Louisa at deckhouse826@gmail.com or 0428227000 and we will endeavour to put matters right. Any complaints not reported to us at the time and only reported after the guest has returned from holiday will not be considered by the owner.
  47. We reserve the right to make reasonable amendments or additions to these terms and conditions without notice.
  48. This property is privately owned and is our home. We anticipate all guests will enjoy the facilities as we do and treat the property with the same respect that they would within their own house.

Other helpful materials such as emergency contact details, bin collection days etc. are included in the Guest Information/Welcome Book at the property.
